Email Proves SCO Was Wrong About Linux

Groklaw has obtained an email written by a consultant for SCO that clearly states:

At the end, we had found absolutely *nothing*. ie no evidence of any copyright infringement whatsoever.

I don’t think it gets much clearer than this — There Is NO Copyright Infringement by Linux of SCO Unix Source Code!

The email, which had been previously sealed by the court, was written by Michael Davidson, who reviewed the findings of the outside consultant hired by SCO to search for copyright infringements in the Linux source code.

It’s interesting to note that the email says SCO never had any reason to believe that there were any copyright infringements in the Linux code other than their belief that there was no possible way that Linux came about without someone, somewhere having copied pieces of proprietary SCO Unix source code.

You would think that SCO would start to back off at least a little after this revelation — wrong. SCO is in the process of attempting to limit the fallout from this email by stating that the Linux code is different from the SCO Unix code because it was rewritten for the purpose of obfuscating code that is essentially the same.
